Deed Restriction Committee
Minutes - March 6, 2007

Chairman Burger, called the meeting to order at 9:00 am. Roll call was taken. John Malacina moved the minutes of January 2. 2007, with corrections be approved. Seconded by Bruce Vermette. Motion carried. John Malacina moved the minutes of February 6, 2007, be approved as presented. Seconded by Sue Artz. Motion carried.
Chairman Burger stated that he has been requested to ask for a meeting with the Compliance Committee for Ruby Dickinson of 14 Caddy Road for parking violations and fine. Discussion ensued. Sue Artz motioned that this request be brought before the Board of Directors for Ruby Dickinson to meet with the Compliance Committee. Seconded by Earl Haas. Motion carried.
Chairman Burger stated that he would like to know if the Deed Restriction Committee would allow a lady on Long Meadow Place to put up a sign (Slow Man) saying "Slow Down Children in Area."
The sign would be put up and the morning the taken down at night. Sue Artz suggested that the lady petition the county for a "Go Slow Children" sign. Discussion ensued. Pete Traverso suggested that instead of allowing this sign, a letter from the RWA should be written in favor of having a Go Slow sign. Steve Kennedy motions that the Deed Restriction Committee request that the Board of Directors write a letter to the county requesting Go Slow Children sign. Seconded by Pete Traverso. Motion carried. Pete Traverso stated the letter should be signed by President Nick Gizzi.
George Burger asked commercial vehicles–what are they? At the last meeting he asked for a subcommittee to come up with their thought. They subcommittee only met once and stated they need more meetings. It was stated that Connie Volpe had quit all RWA committees which left a vacancy on the commercial vehicle committee. Chairman Burger asked to have that vacancy filled. The new committee will consist of Steve Kennedy, John Malacina, Sue Artz, Bruce Vermette and Bob Seneca. Chairman Burger will oversee this subcommittee. They will have their first meeting on March 8, 2007, at 9:00 am.
Steve Kennedy passed pictures that he took of commercial vehicles in Oakland Hill. The majority of the Deed Restriction Committee stated that only two (2) of the pictures showed vehicles that should not be allowed. Steve Kennedy also said he had a problem with company logos being on the sides of the vehicles. He stated that they were larger than the allowed signs in Rotonda West. There was discussion. Bruce Vermette stated that this is no longer a retirement community and many of the people living here are service people and their company has given them a company vehicle.
There is discussion on Oakland Hills and the many problems that are there. Sue Artz states vehicles are only one piece of the problems in this area.
George Burger stated he would like to see a subsection to Section (b) of Section 21 Vehicles and Parking. Section (b) reads: "All vehicles other than automobiles, pickup trucks, SUVs, vans, motorcycles, commercial vehicles, or other vehicles as may be approved from time-to-time, must be parked in a fully enclosed garage." Subsection (i) will read: "Commercial vehicles (trucks or cars used in a trade or business or having lettering or business insignia affixed) may be parked only in the driveway (as defined in Section 21 (d) hereof if the vehicle carries no hazardous chemicals or equipment that in the judgment of the Board of Directors poses a hazard to the health, safety, or welfare of the residents of Rotonda West. No dual wheeled or "Box" type commercial shall be parked in Rotonda West except in a fully enclosed garage. No material shall hang from any commercial vehicle parked outside of a garage. Ladder racks or PVC holders are acceptable only on the top of the vehicles and must present a well maintained and neat appearance as determined by the Deed Restriction Committee."
George Burger would also like to see included in Section 21 Vehicles and Parked Subsection (d) (iv)
"If in the opinion of the Deed Restriction Surveyor, a vehicle appears to be inoperable, a citation (letter) will be issued and will remain in effect until it is proven that the vehicle is indeed both operable and licensed. Proof can be established by demonstration to the Association that both conditions (operable and licensed) exist. Upon proof, the citation (letter) will be negated."
George Burger also stated that he would like to change the language in Article II Directors, Section 5, para D which now reads, "To enter into and upon lots, tracts, parcels and building sites when necessary and with as little inconvenience to the owners as possible in connection with the performance of the purposes of the Association." Added language would be that these powers be delegated to the Association Manager with further delegation to be given to the Deed Restriction Surveyor." There was discussion. The previous manager, Nancy Leighton, was cited by the Sheriff’s office for trespassing. There was discussion. It was suggested that the attorney is contacted to see if this is legal and so that trespassing violation is not issued. Pete Traverso motions that the Board of Directors consider giving powers to the manager to enter properties in Rotonda West Association for the purposes of Deed Restriction violations. Seconded by John Malacina. Motion carried.
Herman Bauer of Annapolis Lane asked the committee if there was any way that renters be screened and be made aware of the Deed Restrictions. Pete Traverso stated that was up to the property owners as they are responsible for their property. He also stated how would you know when property is being rented and how do you enforce this. Discussion followed. Pete Traverso suggested that language should be put into the Deed Restrictions regarding this matter when they are again updated. As of now that would not be enforceable.
George Burger stated the process must be started to change the Deed Restrictions before the Association is turned over to Rotonda West. This would avoid having to go the residents for the changes.
There being no further business the meeting was adjourned at 10:30 am
The next meeting date will be April 3, 2007 at 9:00 am.
