Minutes - March 6, 2007

Chairman Pete Traverso called the meeting to order at 10:30 pm. Roll call was taken. John Carroll motions that the minutes of the January 12, 2007, meeting be accepted. Seconded by George Burger. Motion carries.
Chairman Traverso stated that at the workshop held on March 1, 2007, there were suggestions to further revise the Guidelines for Residential Modification Committee. Pete stated that he would go through each of the existing guidelines and explain the changes. The changes will be underlined.
Swimming Pools. Section 4 has been broken down into three (3) sections. In ground pools, above ground pools, and kiddie pools. Kiddie pools changes read: "These types of pools are by nature temporary and not permanent. Temporary use is allowed for no more than 30 days and pool placement is limited to the rear of the home or structure. Kiddie Pools containing water at a depth of more than twelve (12) inches are not permitted.
Driveways: Section 5 the word extensions has been added. Section 5 now reads: Expansions, extensions or additions to concrete driveway are allow as follows:
A driveway is defined as a concrete surface that provides continuous access to a garage except single lane driveways as proved below.
Existing single lane driveways leading to an existing one car garage in a single family residence may be expanded with a stone, shell or concrete driveway. All other driveways must be construction of concrete.
There was discussion about using other materials of expand driveway such as brick or decorative block. Pete said that when you use brick or the decorative block the base is concrete.
Fences: Section 7 a subsection, Fence Locations, Design, Types and Permitted Heights, has been added to simplify this section.
Detached Garages: Section 9. The added language in this section paragraph one (1). Must be fully enclosed, and Freestanding sheds are not allowed.
Paragraph two (2) added to detached garages window design conform to existing residential structure.
Paragraph three (3) added such garages shall measure at least four hundred (400) square feet and have a minimum sixteen (16) foot wide garage door, or two eight (8) foot wide garage door.
Paragraph four (4) added garages for multi-family residence reads such garages shall measure at least two hundred (200) square feet and have a minimum eight (8) foot wide garage door. The committee asked if the garage size could be increased. Pete stated these are the sizes in the Deed Restrictions.
There was discussion. John Carroll stated that the guidelines could be changed from time to time. Pete suggested that this question be posed to the attorney because the Deed Restrictions state 400 square feet for two car garage and 200 square feet for multi-family garages.
Putting Greens: Section 10 shall read, "Putting greens may be permitted and shall be sight screened, well landscaped and not visible from the street. Putting green applications and their locations will be reviewed on a case by case basis.
Playground Equipment: Section 11 will read, "Playground equipment, including trampolines, may be permitted and shall not be visible from the street. Playground applications and their locations will be reviewed on a case by case basis.
Shell and Rock Landscaping: Section 13 the first paragraph will read, "The use of shell, rock or similar material as landscaping is permitted. Second paragraph has been eliminated. Third paragraph reads, "Shall and rock landscaping applications and their locations will be reviewed on a case by case basis. Applications must include a maintenance plan.
Storm or Security Shutters: Section 14 paragraph 2 to read "Windstorm may occur at anytime, though they are most prevalent during the period of June 1 through November 30. The National Weather Service defines this time period as Hurricane Season. A. Temporary Shutters has been changed to A. Short term use of Shutters. First sentence reads, "Residents may install/deploy shutters on their property without RMC approval any time after the National Weather Service issued a weather advisory, such as a watch or warning, for a tropical storm, hurricane or tornado that would impact the Cape Haze Peninsula and Rotonda Areas. B. Semi-permanent shutters has been eliminated. C Permanent shutters has been changed to Long Term shutters: and shall read, "Residents may install these type of shutters on their property for longer periods of time. Review and approval by the RMC is based on a case by case basis. All plywood shutters must be painted the same as the main color of the home.
RMC Authority: Section 16 first paragraph to read, "The review time for approval or disapproval of an RMC allowed modification is ten (10) business days after the receipt of all required items and property completed forms. Second paragraph to read, "The review time for approval or disapproval of any allowed modification requiring a case by case basis review, is forty five (45) business days after the receipt of all required items and property completed forms. Paragraph 7 to read, "RMC review criteria and construction specifications may be subject to change from time to time and are not solely limited to the items referenced in these RMC Guidelines.
RMC and RWA Non-Liability: First paragraph to read, "The review and approval or disapproval of all plans and specifications submitted for any proposed modification or construction shall NOT be deemed approval or certification of the proposed modification or construction for structural safety or conformance with any government building codes or any insurance liability. There was discussion regarding insurance liability.
George Burger suggests doing an index for the guidelines.
John Eisele asks if the meetings could be after 2:00 pm because of his work schedule.
John Carroll suggested that any questions needed to be answered by the attorney should be done before the guidelines are rewritten. John suggested that Pete ask the Board of Directors for permission to go to the attorney .
There being no further business the meeting was adjourned at 12:15 pm
The next meeting will be March 22, 2007, at 2:30 pm.
