Chairman Burger called the meeting to order at 9:00 am. Roll call was taken. Minutes of the meeting were not presented as they had not been transcribed.
Chairman Burger stated that as of this meeting only one member of the Board of Directors has gotten back to him regarding the revised Deed Restrictions.
The Deed Restriction Committee was to hear an Residential Modification application of a resident on Sportsman Road asking relief to have a six (6) foot fence around the property as there is a sexual predator in the neighborhood. Chairman Burger stated he called the petitioner and they said would like to put this on hold until further notice. There was discussion regarding this application. It was stated that perhaps a four (4) foot solid and two (2) open style fence be allowed until the applicant or and sexual predator move. There was also discussion of what the liability to the Association would be if the requested was denied and something were to happen to the applicant’s children. It was suggested that the attorney be asked what was the liability of the Association in matters of this kind. It was also suggested that the applicant get an invisible fence which would set an alarm off letting them know that someone or something is on their property.
Jay Lyons spoke of what he would like to try a new method of management for Deed Restrictions and gave a time table of April to be put into operation. He would be going out personally and speaking with violators and give them the Deed Restriction booklet from the last printing.
There was a meeting at 10:00 am with Jay Lyons and residents of Mariner Lane regarding a renter who is constantly violating the Deed Restriction. It was suggested that the Deed Restriction Committee be part of this meeting. It was stated that the renter swaps plates on vehicles, has children solicit door to door in the neighborhood for the father, that a canoe has been stolen from a neighbor, that the outside of the house is unkempt and not up to the standard of the neighborhood, trash barrels left in swale for days. Car being parked on front lawn and on the swale. Children riding motorized, unregistered cycles in the street and neighbor’s yards and driveways, un-licensed dogs in the house and being allowed outside un-restrained and the children trying to sell the dogs door to door and frequent use of loud, inappropriate language. A petition was given to the Deed Restriction Committee. The residents of Mariner Lane stated this area would end up looking like Oakland Hills.
Jay Lyons addressed the residents stating that the majority of the problems emanating from this address had to be given the Charlotte County Sheriff’s Office for action. He said the Deed Restriction violations will be handled by the office.
There being no further business the meeting was adjourned at 11:00 am
The next meeting will be March 4, 2008 at 9:00 am
